These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and Red Seal Ace, operated by Anna Lonkina (Sole Proprietorship) ("we", "us", "our"), regarding your access to and use of https://redsealace.com and its digital testing platforms, study materials, and related services (collectively, the "Platform").

By accessing or using the Platform, registering an account, or purchasing an access pass, you explicitly agree to these Terms. If you do not agree, do not access or use the Platform.

Business & Operator Identity

The Platform is owned and operated by Anna Lonkina as a sole proprietorship under the trade name Red Seal Ace, based in Burnaby, British Columbia, Canada.

Educational Disclaimer & Code Updates

Independent Preparation Tool: Red Seal Ace is an independent exam preparation platform. We are not affiliated with, associated with, authorized by, endorsed by, or in any way officially connected with SkilledTradesBC, the Canadian Council of Directors of Apprenticeship (CCDA), the Red Seal Program, or any Canadian provincial or territorial apprenticeship board.

No Guarantee of Exam Results: While our practice materials reflect current examination guidelines, we make no warranty or guarantee that utilizing this Platform will result in a passing grade on the official Red Seal exam or any provincial certification test.

Plumbing Code References: Study materials and question banks are developed based on standard Canadian plumbing codes (such as the National Plumbing Code of Canada) and trade principles. Codes vary across provinces and local Authorities Having Jurisdiction (AHJ). Users are responsible for verifying local code variances and regulatory amendments.

Single-User License & Anti-Sharing Policy

Personal, Non-Transferable License: Each purchased pass grants a single, individual, non-exclusive, non-transferable license for personal study use only.

Account Credentials: You are strictly prohibited from sharing your login credentials, sublicensing, or distributing your access to other apprentices, instructors, trade unions, or third parties.

Session Integrity & Anti-Scraping: Simultaneous logins from different locations, automated data scraping, crawling, bulk downloading, or exporting questions/answers are strictly prohibited and will result in immediate termination of the account without notice or refund.

Pricing, Payments, and Billing

Currency: All transactions and prices listed on the Platform are in Canadian Dollars (CAD).

Payment Processing: All payments are processed securely through Stripe. By initiating a purchase, you agree to Stripe's terms and authorize the charge to your chosen payment method.

Fixed-Term Purchases: Unless explicitly specified as a recurring subscription at checkout, our access passes (7-day, 30-day, 90-day) are one-time, non-renewing charges for the duration specified. Access automatically terminates at the end of the paid term.

Strict Refund Policy for Digital Goods

Immediate Delivery: Upon successful payment, the Platform immediately provides full access to our proprietary questions, interactive exam simulations, and analytics.

No Refunds After Access: In accordance with standard consumer protection practices for immediate digital content delivery, all sales are final and non-refundable once an account has logged in or accessed any practice questions.

Technical Exceptions: If an unresolved technical failure directly attributed to our infrastructure completely prevents platform access for more than 48 consecutive hours, and our support team is unable to resolve the issue, a pro-rated or full refund may be issued at our sole discretion upon receiving written notice.

Intellectual Property

All content, questions, answers, explanations, graphics, software, code, layout, and visual interfaces are the exclusive intellectual property of Red Seal Ace and Anna Lonkina. You may not modify, reproduce, republish, distribute, sell, or exploit any portion of our materials without express written authorization.

Limitation of Liability

To the maximum extent permitted by applicable Canadian law, Red Seal Ace, its operator (Anna Lonkina), and any affiliates shall not be liable for any indirect, incidental, punitive, or consequential damages, including loss of wages, trade certification delays, retake examination fees, or business interruption arising out of your use or inability to use the Platform. Our total aggregate liability for any claims shall not exceed the amount actually paid by you to the Platform within the preceding 30 days.

Governing Law and Jurisdiction

These Terms and any disputes arising out of or related to your use of the Platform shall be governed by and interpreted under the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any legal proceeding shall be subject to the exclusive jurisdiction of the courts located in British Columbia, Canada.
